The Downfall of Builder Brian Estes and RnB Custom Guitars
The man in the video above is Brian Estes, aka Big B Smiles, and he was/is the builder behind RnB Custom Guitars.
In August of 2011, I came across Brian’s youtube videos of some of his guitars. Since I was in need of a Strat for the purposes of pedal demos, I decided to do some research on Brian and RnB guitars. I found a bunch of wonderful things people had to say about his craftsmanship and the sound and playability of his guitars. His guitars were touted as just as good if not better than a Fender Custom Shop guitar for a fraction of the cost. At the time, Brian was offering a discounted price on his guitars via Ebay auctions. He and I emailed back and forth for a few weeks and I was finally able to pull the trigger and send him about $1,300 for a custom RnB Strat with jumbo headstock and tweed case.
At the time of my purchase, the guitar was promised to me in about 6 weeks, which seemed extremely reasonable for a custom built guitar. He told me he would put a rush on it. Being that I like to showcase new equipment and builders when I can, I had decided to hold off on doing a rather big demo for musicradar.com until I received my new guitar.
Fast forward to Sept 30th. I had yet to receive any correspondence from Brian, so I decided to reach out and inquire about the status of my guitar. Brian wrote…
“Hi Fuzzy, got you in the paint shop now. The EPA came in today and I have to move all my chemicals out to another city zoned for industry. Your most likely looking at 4-5 more weeks there Fuzzy Girl. It will well worth the wait and I will go all out to make sure this one is full of Mojo for your video’s. Sincerely, Brian”
I decide to just let the man have some time because I know it has to be very difficult to keep up with orders the closer we get to the holidays. I hear nothing from Brian for the next few weeks. So, I decide to reach out on Nov. 15th to see how he is making out. Brian wrote….
“Almost there Fuzzy, the cold spell we have had has set me back a few weeks of spraying clearcoats. You are in the sanding stage and will be coming up to the bench here soon for assembly and relicing!”
Great! My guitar will soon be ready.
About two weeks after that correspondence, I was involved in a hit and run accident and was left bruised and battered and temporarily paralyzed…. so, the guitar was then far from my mind.
Many weeks go by as I am recouping and my mind begins to drift back to the guitar. I begin to wonder why I haven’t received any word from Brian. It is now January 13th….. if my guitar was in the sanding stage in November, one would assume it would be done. I reach out to Brian once more and ask for an update. A week goes by and I receive no reply.
At this point, I started to get very nervous. I decided to visit Brian’s site to see if perhaps there is any news or updates posted on his site. I type in the address in my navigation bar…… but all I am taken to is a white page with the words “This account has been suspended”. Hmmm…. maybe I typed that in wrong. I tried again….. same response. I’m on a lot of meds at this point, so maybe my eyes and hands just aren’t coordinating correctly. I figured I would go through the link to the store from his videos. I do so and I come to the same message.
At this point, I am now freaking out. I sent this man $1,300 5 months ago for a guitar and I have nothing to show for it AND now his website is gone?!?!?!?
This prompted me to do an online search….. and that is where I found a blog post on rhythmicguitar.com by Jeremy about his custom RnB guitar….. and how he had to fix it!
I urge you to read his two articles here… Rhythmic Guitar.com
Jeremy had ordered a guitar from Brian on January 19th, 2011 and his blog post was dated Nov 7th 2011…. about 10 months after he ordered his guitar. After finally receiving his guitar, he posted the following pictures….
As Jeremy says in his posts, the trem block was broken, the string spacing was completely off, there was a piece of plastic/cardboard from the nut packaging cut to the shape of the neck heel, it was supposed to be a shim to angle the neck, the tuners are off, the paint is damaged, etc, etc. Again, I recommend you read Jeremy’s posts, especially in regards to how he fixed everything and how much he paid for each item….
Oh and did I mention that Brian refused to refund Jeremy any money?
After finding this website, I began reading all of the comments…. and lo and behold, there are many, many people that have been waiting months and months for their guitar from Brian…. and the excuses these people are posting from Brian are the exact same excuses I was receiving….. only they had been receiving them for many more months than I had. One gentlemen has been waiting since 2010 for his guitar from Brian!!
So at this point, I am extremely worried, having already sent him $1,300 and am just now beginning to see the scope of what is happening. This is besides the point that after being in the accident, I could use the $1,300 to pay towards medical bills..
On January 26th, Brian finally writes me back….
“I am sorry for not getting back to you sooner. I have been very ill. I have a life threatning heart condition and have fallen behind in my guitars. I assure you that I have not forgot your large headstock Strat. They say they cannot operate on my heart what I need is a heart transplant. I am taking the meds they prescribed and have a pacemaker’defibulator implant to try and keep it going. I am working on guitars and though I have been overwhelnmed lately I have not forgot you! It will come! I promise!
Sincerely, Brian”
Now, I can completely understand someone being sick or ill and having issues with completing work. Given my current situation, I COMPLETELY understand that. I’m not that much of an insensitive bitch
However, I can’t help but realize that he has many other individuals that have been waiting months and in some cases, over a year or almost two years for their guitars.
Something is fishy here….. something just does not sit right with me. Why did he promise me my guitar so quickly? Why were the excuses I was receiving the exact same excuses others have been receiving for months? Why did he message another buyer in November that he was out on the West coast playing some big paying gigs? Why is his website account suspended? Why has paypal suspended his account? Why will he not refund his buyers money?
After thinking about it, I decided to ask Brian for a full refund of my money. If he did order the custom neck, I would eat that cost and just ask for the neck to be mailed to me and for the remainder of the money to be refunded. I was told… “If I had it to send to you I certainly would.”
Since the money was sent via paypal, I decided to open a paypal case against him….. however, little known fact here, paypal will not investigate anything that is over 45 days. Being that the guitar was promised in 6 to 8 weeks, that built in 45 day period of protection would expire before the guitar was even supposed to be completed.
In reading over the comments on Jeremy’s blog, I found that some buyers began contacting the authorities in Brian’s home town. The police stated that a detective was sent out to Brian’s home and that he had agreed to complete the remainder of his orders….. however, based on what I had seen from Jeremy’s pictures, would I even want the finished product?
Now that brings us up to the present. I have contacted the authorities in Brian’s town and lodged a complaint and I have also submitted a fraud case through my credit card company, however, since it was about 6 months ago, I am not very hopeful.
In the end, I am not looking to be vindictive here. I am not looking to completely tear down the reputation of a builder here…. from all of the comments from older buyers, Brian used to build some excellent guitars. The reason I went to him and wanted to buy one of his guitars was because they sounded amazing and people had nothing but excellent things to say about what he did. I am just not sure what happened or where things went wrong for RnB Customs.
My concern here is that I am not the only one….. not by a long shot. Brian should have never taken my order or I should have been informed about his current condition and just how backed up he was in regards to the guitars. I am not sure what believe in regards to the correspondence I have thus far received from Brian.
My goal now is to create a hub for anyone that has paid for a guitar from Brian that will most likely never show up. If we join together, keep each other posted on any new happenings, post any emails we each receive from Brian, etc…. I am sure we will be able to come to some sort of resolution. And that is basically all I want……a resolution.
If you are one of the many that have paid Brian and have not be able to come to a resolution, please contact the Volusia County Sheriff’s office to lodge a complaint..

Also, there is a thread over at The Gear Page in regards to this, if anyone needs any further information…TGP RnB Thread
Again, I feel that this is extremely unfortunate and when I see that there are others receiving the EXACT same excuses and updates as I have been…. well then there is something not quite right here.
In the end, we sent Brian money to build our dream guitars…. and that is exactly what we all got…. just a dream.

As written in Gear Talk:
Yikes! Sadly, we live in exactly this kind of world. I have had a few guitars and amps built for me, but I am very careful to make sure that I investigate the builder to the best of my ability first. I also always make sure that I get photos as the build progresses. The other thing I do is to split the payment. If it is a good and honest builder/ luthier/ geek, then that type of thing should be perfectly acceptable. Even the really expensive and very well-known builders understand the need for customer assurance and good customer service. That’s how they get and keep customers. Best of luck with this problem. I don’t think you will get a satisfactory result, even if you do get the guitar eventually. But, if you want to get a really nicely-built guitar for reasonable money, please let me know and I will be glad to put you in touch with the right folks who will deliver what they promise.

I think one thing I would ask is why anyone who send the full amount to the guy. I would think 20% up front and the rest on completion of the order. I don’t know. I wouldn’t give the dude any more wiggle room, I would think everyone could try a joint lawsuit, or maybe get one of those TV consumer advocates. I would make a big noise about this, and wouldn’t be as nice and understanding as you have been. I’ve been screwed over enough times to have that attitude with one of the guitar pedal makers that I can’t seem to locate now.

“I think one thing I would ask is why anyone who send the full amount to the guy. I would think 20% up front and the rest on completion of the order.”
I think this is the real message here. I’ve seen that among many custom builders the common practice is to put 20% down as a deposit. I’d also follow PayPal’s guidelines, and give the builder 30 days to show results, which you can then “blame” on PayPal, noting their 45 day policy. This should be MORE than reasonable.
I’m afraid your money is gone. While he MAY be sick, etc., the fact is that he’s not the only one who’s fallen on hard times, and your problems are just as valid as his (alleged) ones are. Your only real recourse would be small claims court, and you’re probably too far away for this to be a reasonable option.
Unfortunately, this is one of those “caveat emptor” things. Good luck, nonetheless . . .
Feb 08, 2012 @ 13:19:04
Even though it has been several months, disputing this with your credit card company is a smart move. If you used the credit card through PayPal, then the CC company should be able to get your money back without a problem, especially with the documentation you can provide them.
Feb 08, 2012 @ 13:59:41
Wow, that is incredibly scary. It “feels” like he’s gone from a reputable business to out and out fraud in order to pay for whatever money troubles he’s got himself into. It’s hard to buy any excuses, medical or otherwise, at this point. I truly hope that you get some sort of resolution, and have the opportunity to take this man to small claims court to get your money back.
On another note, I hope you’re doing better! I’ve been a follower of your blog for some time now and when you weren’t posting new blogs I was hoping you weren’t leaving the site behind. Take care FBG, and get well!

Show no mercy Fuzz box girl, muppets like this guy deserve all they get, good riddance, shame your lolly, I doubt you will see it again.
Feb 08, 2012 @ 18:55:25
You, and the other victims of this fraud, may have recourse in Federal court, since he was conducting his business across state lines, and using the Internet to solicit business. However, even if you won against him in court, that doesn’t guarantee that you would ever see your money, much less a guitar worth what you paid. I’m so sorry you’re dealing with this, on top of your recovery. Wishing you all the best, WP

Dear fuzz box girl,

yikes! – Glad to hear you are on the mend FBG – unfortunately, Brian has screwed the pooch – BUT screwing over MUSICIANS is a heinous crime and punishable by any crap that comes back to bite him in the ass – at the very least, he SHOULD have had a 50% down @ time of order policy – again, seriously bummed for you – this situation reaffirms MY personal gear-policy and goes back to my mantra – “guitar-in-hand=$$$ going out” – sorry for your hassle…live and learn…

Ok, i am one of the many who was stuck in limbo with Brian. After waiting a little over a year i finaly got a full refund from paypal today. I think if you keep trying and calling you will get some help. I am really sorry to hear that so many people are going thru this like i did but i really think it will eventually work out. I have to say that Brian can build some great Guitars. I have a strat that he built last year and it is exactly what i wanted at a great price. it did take longer then he said but it was delivered. I decided to order a tele and prepair for the wait but then he fell off the deep end as you have been reading here and the other blog….. it is a mess.
I am not at all defending Brian and was extremly pissed myself for the way he done things but i just wanted to chime in and give some hope. All the people out there that ordered guitars from Brian, good luck.

Originally purchased a ’65 relic copy from Bry on Ebay. I wanted to cancel the order although with some persuasion from him on the phone,I went ahead with the order. It was my choice. Received a Robert Johnson body with what I believe were Lollar P’s. $1650.00. My girlfriend still contends it was her favorite, and I have owned many high end guitars. I communicated with him off and on via phone and E mails. After awhile the relic tuners froze up due to the rust, although I had no costs other than the shipping and was covered by his lifetime warranty. I decided to have different P’s installed so I shipped it off again later, put in new P’s and received it back in a timely fashion. Bry told me he talked with his partner, who regrettably informed Bry that I could have used the 65 as a trade, instead of just pickup replacement. Well I couldn’t resist the possibility of a high end strat and almost immediately got started with the transaction. He was to build the new guitar with his stock shop Kleins,Wildwood body, and stock neck.I pestered him to let me custom order S 1′s from Klein and a custom neck. I sent the money for these improvements. I talked with Brian on the phone almost everyday and was always replied to by Emails. Granted. It did take a long time.Around 10 months. There were problems with spraying finish in the Florida shop. Excessive humidity. The day before he was to send it out to me,he accidentally set the guitar on his workbench wich had some paint thinner on it, and it incurred a blemish on the back. I would have prefered to have had it repaired before being sent out, told him so, and again was persuade to wait until I received it and then make a decision about possibly sending it back to his shop,if I still desired to have it refinished. I never did return it for the repair and did not discuss it with him. Brian treated me as a friend. Although most communication stopped after I received my guitar. We would talk on the phone sometimes for an hour or longer just shootin’ the skeet. He spoke of health concerns at length, including his heart condition. I grew to respect him as a person and craftsman. I am not doubting all the client difficulties. Just surprised and saddened at what I’m hearing. I think he simply bit off more than he could chew. Hoping all find reconciliation. By the way, I LUV my guitar. Bry too!

I must say, these stories are horrible. I bought many guitars from Brian. I’m very fickle. I still have the sonic blue strat he built for me amd a custom telecaster that is just as great as the strat. his finish work is superb. I hope He makes you all whole again. Good Luck, Brez
His guitars were a home run, as far as bang for the buck, prior to his assumed difficulties..

Hi,
thi is Ralf, Germany.
The same to me. In Mai 2011, I’ve ordered one RnB Custom Telecaster, paid 1300,- US$ and just kept getting e-mails that he was sick, on vacation, etc. Since December 2011, I have not heard from him.

Really sorry to hear about this bad experience of yours, Jane. Both of them. Really hope you’re recovering from your car accident. Have missed your regular postings on my page. They are in a class of their own!
I was going to suggest you report this guy to the police. Isn’t it an offence to take money from customers without sending any goods to them? I dare say you’ve already considered doing this, and found it got you nowhere. But shouldn’t this guy have some kind of public liability insurance to cover eventualities like this?
I hope you get some satisfaction from your efforts here. I posted your comments on my page to drum up some support for you.
Get well soon, Jane. Let’s have some more of your great humour and personality again soon.
Take care.
Love,
Mark

Hey all, i was asked to post my experience with paypal in these matters and how i recieved a refund after a year of headaches with Brian and his ebay deals. I orderd a Telecaster on 01-30-2011. After a year of waiting and seeing all the issues brian was having i tried to get a refund.
After several calls to paypal i was able to escalate my dispute into a claim. Paypal gives the seller ten days to contact them. If the seller does not contact paypal within ten days then they issue a refund and go after the seller. I complained that Brian was allready being investigated and that there was many more having these problems. I did get some help after calling several times so maybe you just need to talk to the right person.
I also wanted to say that the Tele was to be my second guitar from brian. I ordered a strat from him last year and after about a seven month wait i did recieve an awesome guitar from Brian. I decided to order a tele and waited about 8 months but he fell off the deep end and crashed.
I really dont know what his deal is now but it is not good.
I wish i could tell you more about getting a refund but thats about it. Just keep calling and complaining i guess.
Good luck………..

Everyone,
Today I sent a tip to the FBI in regards to Brian’s interstate and inter-country defrauding. Don’t use the IC3 complaint form. Use the web address I am attaching below and include all relevant information as well as any contact information you have for Brian. This goes to the FBI rather than IC3 which is only a partnership with the FBI. Perhaps if the remainder of us that have been scammed by Brian send in tips, we can see some sort of justice.
